Lease law is the field of private law that regulates the rights and obligations arising from the lease agreement between the lessor and the tenant. In Turkey, lease relationships are addressed under the provisions of the Turkish Code of Obligations and cover both residential and commercial leases.

Although lease agreements may be made in writing or orally, written agreements are of great importance in preventing disputes. The determination of rent, increase rates, deposits, manner of use and eviction conditions are the most frequently raised topics in lease law. In particular, the statutory limits introduced on rent increase rates in recent years have made lease law even more topical.

Eviction actions are among the most common types of case in lease law. Eviction demands may arise for reasons such as the tenant’s failure to pay rent, an eviction undertaking, eviction due to need, or use contrary to the agreement. In addition, actions for the determination and adaptation of rent hold an important place in practice.

Both the lessor and the tenant have legal rights and obligations in lease relationships. Preserving this balance requires the legal framework to be correctly assessed in resolving disputes. Lease law is a continuously developing field in line with current legislative changes and judicial decisions, so accurate guidance is of great importance.
