Family law is a branch of private law that regulates the rights and obligations arising from individuals’ family relationships. In Turkey, family law is primarily shaped by the provisions of the Turkish Civil Code.

Marriage, divorce, custody, alimony and matrimonial property regimes are the main topics of family law. Divorce proceedings are divided into uncontested and contested cases, involving different legal processes depending on the parties’ intentions and the matters in dispute.

Following a divorce, matters such as custody arrangements, personal contact with the child and child support come to the fore. Poverty alimony and pecuniary/non-pecuniary compensation claims are also among the important elements of family law.

Because the parties’ personal and emotional circumstances are taken into account in family law disputes, the processes must be conducted with sensitivity. The aim in this field is to protect the interests of the parties and, in particular, of the children.
