Enforcement and bankruptcy law is a branch of law concerned with enabling creditors to collect their receivables through the power of the state and with regulating debtors’ financial situations within a legal framework. The principal source of this field is the Enforcement and Bankruptcy Law No. 2004.

Within enforcement law, there are proceedings with and without judgment, attachment procedures, payment orders, and avenues of objection and complaint. Where a debtor fails to pay, creditors may initiate enforcement proceedings to pursue collection through lawful means. Debtors, in turn, may exercise their rights of objection and litigation against unjust or improper proceedings.

Bankruptcy law generally comes into play where real or legal persons engaged in commercial activity fall into financial difficulty. Bankruptcy is a collective enforcement route aimed at liquidating all of the debtor’s assets and distributing them to creditors. The institution of composition (concordat) allows a debtor to restructure their financial situation before bankruptcy.

Because enforcement and bankruptcy processes involve technical detail, acting in accordance with time limits and procedure is of great importance. Attachment, sale, ranking schedules, removal of objections and negative declaratory actions are among the core disputes of this field.
