Expropriation law is the branch of law that regulates the acquisition by the state or public legal entities of privately owned real property, for reasons of public interest, in return for payment of its value. In Turkey, the expropriation process is conducted within the framework of Article 46 of the Constitution and Expropriation Law No. 2942, along with related legislation.

Expropriation procedures begin with an administrative decision-making process and often produce serious consequences for property rights. Among the problems most frequently faced by property owners in this process are the setting of a low expropriation value, urgent expropriation decisions and de facto seizure. Actions for the determination and increase of the expropriation value are among the legal remedies most frequently resorted to in practice.

Expropriation law also encompasses the concept of de facto expropriation without compensation. Where the administration physically interferes with real property without any expropriation decision, the owner’s right to claim compensation or value arises. Such disputes may be assessed both in administrative and in judicial jurisdiction.

Given the technical and legal aspects of the expropriation process, careful follow-up is of great importance to avoid loss of rights. The annulment of expropriation decisions, value determination and increase actions, and de facto expropriation actions are among the core disputes of this field.
